3.1 Parent Attestation and Electronic Signature
As part of the permit application process, parents and legal guardians are required to complete a written attestation certifying the accuracy of the information submitted and their legal authority to enroll the student.
Legal effect of attestation.
The attestation constitutes a legally binding declaration. By completing the attestation, the parent or legal guardian certifies under penalty of perjury under California law (Penal Code §118) that the information provided is true, correct, and complete to the best of their knowledge. Submitting false or misleading information may constitute perjury and may result in immediate permit revocation, account termination, and referral to appropriate authorities.
Electronic signature.
The typed name entered by the parent or legal guardian at the conclusion of the attestation constitutes a valid electronic signature under the California Uniform Electronic Transactions Act (UETA), Civil Code §1633.1 et seq., and has the same legal force and effect as a handwritten signature. By typing their name, the parent or legal guardian expressly agrees that they intend this act to serve as their electronic signature.
What constitutes a valid signature.
A valid attestation requires: (a) the parent or legal guardian to have read the full attestation text; (b) entry of the parent or legal guardian's legal name in the signature field; and (c) submission of the completed permit application. All three elements must be present for the attestation to be valid.
Liability shift.
By completing the attestation, the parent or legal guardian assumes full responsibility for the accuracy of all information submitted, including but not limited to: the student's identity, age, grade, school enrollment, and e-bike make, model, class, and serial number. LexBran Group, LLC d/b/a RidePermit relies on the accuracy of parent-submitted information and shall not be liable for any harm, loss, or legal consequence arising from false, inaccurate, or misleading information provided during the application process.
Record retention.
RidePermit retains a timestamped record of each completed attestation, including the typed signature, submission date and time, and IP address, for the duration of the permit plus seven years. This record may be used in any legal, administrative, or regulatory proceeding relating to the permit or the student's e-bike use.
Parental authority.
By completing the attestation, the parent or legal guardian represents and warrants that they are the legal parent or guardian of the student being enrolled, that they have authority to bind the student to the terms of the permit, and that they are at least 18 years of age. Creating an account or submitting an attestation on behalf of a student for whom the submitter has no legal guardianship may constitute fraud.
